DE Unemployment Insurance (UI) Overview

 

Delaware Division of Unemployment Insurance logoDelaware Unemployment Insurance (UI) serves workers who are unemployed through no fault of their own by providing temporary income maintenance during their period of unemployment and making referrals to re-employment services.

The Division of Unemployment Insurance also serves employers by ensuring that only those unemployed individuals meeting all eligibility criteria receive Unemployment Insurance (UI) benefits, thereby protecting future increases in employer tax rates and the solvency of Delaware's UI Trust Fund.

To be eligible you must:

·      have earned a minimum amount of wages; and

·      be able to work, available for work, and actively seeking work; and

·      register for work with the Division of Employment and Training (unless exempt by law). (For DE&T contact information, go to: http://www.delawareworks.com/emptrain/contactus.shtml.)

You must file for benefits at the nearest Unemployment Insurance Claims Office. When filing, the following information will be requested:

·      name

·      address

·      Social Security card (may substitute W2 or pay stub with name and Social Security number imprinted on it, accompanied by picture ID such as driver's license)

·      work history - names and addresses of all employers over the last 18 months. (Veterans for whom military service falls within the last 18 months must present DD 214 (Member 4) form in order to file for benefits.)

·      reason for loss of job

YOU MAY BE DENIED BENEFITS

If you are unable to work, or are unavailable for work;

If you have failed to actively seek work;

If you quit your job voluntarily without good cause attributable to your work;

If you are discharged from your job for just cause in connection with your work -- such as lateness, unexcused absences, or violation of company rules;

If you are unemployed by reason of commitment upon conviction and sentencing to any penal institution;

If you refuse to accept a job offer for which you are reasonably fitted and which pays the general rate for that type of work;

If you put undue restrictions on the type of work, number of hours or amount of pay that you are willing to accept;

If you are unemployed due to a labor dispute;

If you fail to participate in reemployment services; or

If you do not report to the local office and/or do not mail pay authorization forms as required.
