DE UI - Benefit Amount Calculation

Your Unemployment Insurance (UI) Weekly Benefit Amount (WBA) is calculated based on your wages during your Base Period.

Your WBA will be 1/46 of the total of your wages in the two highest wage quarters in your Base Period. The minimum benefit amount, however, is $20 and the maximum is $330 a week, assuming you are eligible. (See DE UI - Earnings Eligibility as well as the UI Overview for more information about earnings eligibility for Unemployment Insurance.)

Calculating the Weekly Benefit Amount (WBA)

The approximate amount you will receive each week may be computed using the following formula:

·             Determine the Base Period for your claim.

·             Determine the total amount of wages you were paid in covered employment during the base period by calendar quarters.

·             Determine which two quarters yielded highest wages.

·             Divide the total wages paid in those two quarters by 46 to calculate the approximate weekly benefit.

Calculating the Number of Weeks you get WBA

The number of weeks that you will receive UI benefits depends upon your total wages during your entire Base Period.

You are entitled to receive 26 weeks of your WBA -- or a total amount of benefits equal to 50% of your Base Period wages -- whichever is less.

Example:

Let's say that you had no wages in the first three quarters of your four-quarter Base Period and then you got a job and earned $3,450 in the fourth quarter (about $265 per week):

Your benefit amount would be $75 per week ($3,450 divided by 46 = $75).

If you were to get the full 26 weeks of benefits, that would be $1,950 ($75 times 26 = $1,950).

However, 50% of $3,450 is $1,725. Since $1,725 is less than $1,950, you would get your $75 benefit for only 23 weeks. ($1,725 divided by $75 = 23).

Monetary Determination

When your claim is processed, a "monetary determination" will be calculated and you will receive a copy. The monetary determination will indicate the name(s) of the employer(s) for whom you worked during your claim base period and the wages you earned in each calendar quarter.

If you are monetarily eligible for benefits, the monetary determination will also indicate your weekly benefit amount (WBA), maximum benefits receivable, and the duration of your claim.

If the employer and/or wage information on the monetary is incorrect or if any employer and/or wage information is missing, please report to the local office where you filed your claim immediately.

When you report to the local office to review your monetary determination, please be sure to bring your Social Security Card and proof of the missing or incorrect employment (W-2, pay stubs, etc.).

Once the monetary determination is complete, if you disagree with that final determination, you may file an appeal.
