EAEDC - Categorical Eligibility for Caretaker Families - Massachusetts

To be eligible for EAEDC, a family must meet all of the requirements for being either a Parental Family or a Caretaker Family. A Caretaker Family includes:

·      A dependent child(ren) under 18 years of age, and

·      The dependent child’s siblings or half-siblings, if any, and

·      A caretaker who is 18 years of age or older

The caretaker must not be directly related to the family by marriage or adoption (see106 CMR 203.585 for details), must live in the same home as the dependent child(ren), and must have legal custody or guardianship of the dependent child(ren). If the caretaker does not have legal custody or guardianship of the dependent child(ren), verification of good cause for not having custody or guardianship must be provided through a statement, signed by the caretaker, which includes the reasons legal custody or guardianship places him or her or the dependent child at risk of serious harm or emotional impairment. Official documentation from other sources must also be provided indicating the risk exists.

If the caretaker is considered a member of the household, is between the ages of 18 and 59, and is not in school, training, nor gainfully employed, he or she must register for work with the Division of Employment and Training (DET) as a condition of initial and continuing eligibility, and must actively seek employment and maintain registration with the DET.

To be considered in school, the caretaker must be regularly attending school full-time. To be considered gainfully employed, the caretaker must be employed 30 or more hours per week earning at least the federal or state minimum wage, whichever is less. To be considered in training, the parent(s) must be regularly attending a full-time training program for 80 percent of the full-time scheduled hours of the program.

If the caretaker is included in the household and the youngest dependent child in the household is 15 years of age or older, the caretaker must meet the Transitional Employment for Massachusetts Parents (TEMP) requirements.
