DE TANF - Family Cap

No additional Temporary Assistance for Needy Families (TANF) cash benefits will be issued due to the birth of a child, if the birth occurs more than ten (10) calendar months after:

·      The date of application for TANF; or

·      For active cases, the date of the first re-determination after October 1, 1995.

While no additional TANF cash benefits will be issued for the child(ren), the child(ren) will be considered TANF recipients for all other purposes, including Medicaid coverage, child care, other supportive services and Food Stamp benefits.

NOTE: Children born prior to the periods identified above who return or enter the household are not included in this restriction.

Exceptions

The Family Cap restrictions will not apply in the following cases:

·      To an additional child conceived as a result of incest or sexual assault; or

·      To a child who does not reside with his or her parent; or

·      To a child that was conceived in a month the assistance unit (i.e., the entire family) was not receiving TANF. This does not apply in cases that close due to being sanctioned.

Financial Eligibility and Grant Amounts

Determining financial eligibility and grant amounts for an assistance unit which contains child(ren) affected by the Family Cap provision.

·      The child(ren) are included when determining the assistance unit's need for assistance.

·      The child(ren)'s income and resources are included when determining the assistance unit's income and resources.

·      The child(ren) are not included when determining the payment standard for the assistance unit.

NOTE: A needy child who is ineligible for TANF cash benefits due to the Family Cap provision is not eligible for General Assistance (GA).
