The Delaware Division of Social Services (DSS) evaluates the resources of every Family Budget Group to determine eligibility for public assistance benefits -- Temporary Assistance for Needy Families (TANF), General Assistance (GA), Medicaid, and other programs.
NOTE: The resources of the entire Family Budget Group are compared to the resource limit even if there is more than one TANF Assistance Unit included in a Family Budget Group.
Resources are either available resources or potential resources. A Family Budget Group is not eligible for cash assistance if its available resources exceed $1,000. When potential resources become available to the client, DSS will re-determine financial eligibility. Clients are required to apply for any potential resources that they may be eligible to receive.
NOTE: See TANF - Resource Exclusions for information about the resources that do not count toward the resource limit.
Any resource that a Family Budget Group actually has on hand for immediate use is an available resource. Examples of available resources include:
· Cash on hand
· Checking accounts
· Savings or bank accounts
· State and Federal income tax refunds
Potential resources are resources that an individual has claim to, but does not directly possess. Examples of potential resources include:
· A pending claim for Retirement, Survivors, and Disability Insurance (RSDI)
· An inheritance that has not been through probate
· A pending property settlement that is the result of a divorce action
Interest or dividends from a potential resource that is not yet available is counted as income.
Accrued vacation and/or sick leave are treated as a potential resource when an applicant or recipient requests a leave of absence from employment for a specific period of time. The income when received is treated as earned income if it is paid as a wage and as unearned income if it is paid as a disability benefit through an insurance company.
ALERT: Transfer of Resources: Any individual who transfers a resource valued at more than $500 without being paid its fair market value is ineligible for TANF or GA for two (2) years from the date of the transfer.
