Earned Income Tax Credits (EITCs) are also called Earned Income Credits (EICs). They are refundable tax credits for low income families. (See EITC Overview for details.) EITC payments can be received annually after you have sent in your completed Federal Income Tax form, or you can receive advance payments from your employer.
NOTE: Contact your local Division of Social Services (DSS) Office for information about ways to apply for EITC.
All EITC payments received by Temporary Assistance for Needy Families (TANF) or General Assistance (GA) applicants or recipients are disregarded as income for eligibility and payment purposes. EITC payments are even excluded when determining a family's eligibility under the 185% gross income test. (See Excluded Income for a list of other types of income that are always excluded.)
EITC payments are not defined as earned income even though advance EITC payments are made by the employer.
Applicants: Disregard as a resource EITC payments received in the month of application or in the month preceding the month of application. Any remaining EITC amounts received before this period are a resource.
Recipients: Disregard as a resource for the month in which the EITC is received and the following month. After this period, any remaining amounts are a resource.
