Section 1915c of the Social Security Act authorizes the Secretary of Health and Human Services to waive certain Medicaid rules to enable states to cover home and community-based services as an alternative to institutionalization. States may, under a waiver program, add services and may choose to limit the number of individuals who may receive the services or limit the availability of services geographically.
Georgia has six home and community-based waivers and two demonstration projects that have been approved by the Health Care Financing Administration (HCFA), now known as the Centers for Medicare & Medicaid Services (CMS). During the waiver application process the state had to assure HCFA that the cost of serving individuals in the waiver programs would not exceed the cost of serving those same individuals in appropriate institutional setting(s).
The Georgia Department of Community Health's Division of Medical Assistance may serve only the number of recipients for which funds are allocated through the legislative process. There are nearly always people on the waiting lists for the programs.
