The following kinds of personal characteristics or situations, among others, allow individuals to be exempt from Food Stamp Employment and Training:
· Severe Vocational Deficiencies: Individuals with such severe deficiencies in employability skills that participation in Employment and Training would have only a remote probability of employment or placement in a vocational skills training program.
· Reading or Math Skills below Third Grade Level: Individuals who read or compute below the third grade level.
· Low English Skills and no ESL Available: Individuals who have severe deficiencies in spoken English language and who live in an area remote from available programs in English as a Second Language (ESL).
· Needed Childcare not Available: Work registrants requiring childcare where it is not available or childcare is not available via public transportation within a reasonable commuting distance. The cost of private transportation is prohibitive. (See the Child Care Subsidy Overview topic for information about availability during participation in education and training programs.)
· Reasons of Health: After work registering and prior to screening, the participant becomes incapacitated. Temporary personal exemptions from Employment and Training participation may be granted upon recommendation of a physician or a Division of Vocational Rehabilitation enrollment. A temporary medical exemption is approved if the reason for the exemption is expected to last 60 days or more.
· Lack of Transportation: Absence of adequate transportation to the training program or to employment locations: Work registrant resides in a location not accessible to the Program by public transportation within a reasonable commuting time.
· Lack of Job opportunity: If State Employment Service information indicates that there are essentially no jobs available within reasonable distance of the participant's residence.
· Homeless: Participants who do not have adequate shelter or a permanent domicile. This exemption is granted on a case-by-case basis, when it is not practical to service a particular individual.
· Individuals who are in their second or third trimester of pregnancy: Persons who have begun their fourth month of pregnancy. The probability of work registrants in their second or third trimester of pregnancy obtaining employment or entering and completing training leading to employment is remote.
· Work registrants 55 years of age or older: Individuals 55 years of age or older with no formal skills training, have been employed in any capacity in the last 10 years, and have less than a 10th grade education.
· Individuals who are employed or self-employed: Individuals who are working a minimum of 30 hours weekly or receiving weekly earnings at least equal to the Federal minimum wage multiplied by 30 hours: employment prevents individual from participating in employment and training activities.
· Participant is in a substance abuse treatment program: Individuals receiving substance abuse treatment services who are unable to focus on developing employability skills. Consultation between Case Manager and Substance Abuse Treatment Worker will determine the appropriateness of utilizing this exemption.
Authority to grant individual exemptions rests with the Case Manager, with close monitoring of such exemptions by the Case Manager Supervisor. Final authority rests with the Division of Social Services (DSS) Employment and Training Administrator.
