The Department of Industrial Accidents (DIA) is responsible for overseeing the Workers' Compensation system in Massachusetts. The Department can help you if you are an injured worker, employer in Massachusetts, an insurer or an attorney.
An employee who is injured during the course of employment, or suffers from work-related mental or emotional disabilities, as well as occupational diseases, is eligible for workers' compensation benefits. These benefits include weekly compensation for lost income during the period the employee cannot work. Indemnity payments vary, depending on the average weekly wage of the employee (AWW) and the degree of incapacitation. The statute dictates a maximum benefit of 100% of the Statewide Average Weekly Wage (SAWW) and a minimum benefit of at least 20% of the SAWW.
In addition, the insurer is required to furnish medical services, hospital services, and medicines, if needed. The insurer must also pay for vocational rehabilitation services if the employee is determined to be suitable by the Department of Industrial Accidents (DIA).
