Unemployment Insurance - Disqualification From Benefits - Massachusetts

In general, workers may be determined ineligible and have their claims indefinitely disqualified if they become unemployed for the following reasons:

·      Voluntarily quitting the job without "good cause" attributable to the employer

·      Being discharged by the employer for deliberate misconduct on the job or a knowing violation of a reasonable and uniformly enforced rule

·      Job loss due to conviction of a felony or misdemeanor

Workers may also have their claims disqualified for any of the following specific reasons:

·      Employees who have jobs such as teaching, professional sports, and other such positions and have a reasonable assurance of work in the next academic year, term or season may not receive UI benefits between these periods.

·      Seasonal workers (work fewer than 16 weeks in a calendar year) who are employed by employers who have received seasonal employer certification status by the Division of Employment and Training (DET) may be disqualified from receiving benefits unless they become unemployed during the season for which they are hired.

·      Employees who receive vacation pay during a period of regular employment; wages in lieu of dismissal notice; continuation pay; severance pay; termination pay; dismissal pay; or total disability payments under Workers’ Compensation are disqualified only for the weeks in which such payments can be applied.

·      Individuals who are not available for work, unable to work, or have limitation, without good cause, as to work hours or shift, or fail to make an active search for work will not receive UI benefits.

·      Individuals who are not available for work because of illness (this may be waived for three weeks in a benefit year) will not receive UI benefits.

·      Individuals who fail, without good cause, to accept an offer of suitable employment or fail to respond to an employer's reasonable callback will not receive UI benefits.

·      Employees who are unemployment because of participation in a labor dispute that results in a work stoppage for the employer will not receive UI benefits.

·      People who are full-time self-employed during the claim period are not eligible for benefits.

·      People who hold part-time employment where earnings are an amount equal to or in excess of the worker's Benefit Rate may not receive benefits. Some weekly part-time earnings will be disregarded before deductions are made from the worker's benefits.
