DE Medicaid - Low Income Families with Children - Section 1931

Section 1931 of the Social Security Act establishes Low Income Families with Children (LIFC) as categorically needy and eligible for Medicaid if the following criteria are met:

General or Common Eligibility: The criteria in Medicaid - Eligibility - General for residence, citizenship, etc. These criteria are also called Technical Eligibility criteria.

Child Living with Specified Relative: The family must include a child who is living with a parent or other specified relative. A child is an individual under the age of 18, or an individual under age 19 who is still a full-time student in high school, GED, or equivalent program and will graduate prior to his or her 19th birthday. (Emancipated minors are considered adults.) The rules for determining specified relationships are the same as in Temporary Assistance for Needy Families (TANF) - Specified Relationships.

Financial Eligibility: There are no Resource limits for Section 1931 Medicaid eligibility. The TANF - Income Eligibility rules apply except as noted:

·      Always use the income-eligibility rules for TANF recipients, not applicants. This means:

·                    Financial eligibility for both applicant and recipient families will be calculated using the 30 and 1/3 disregard if applicable. This disregard allows the deduction of $30 plus 1/3 of the remaining earned income after the $90 standard allowance for work connected expenses is subtracted. (See Earned Income Disregards for information about time limits on the $30 plus 1/3 disregards.)

·                    Net income is compared to the Standard of Need, not the Payment Standard. (See TANF Income Limits.)

·      All earned income is disregarded for the second and third months of eligibility.

·      Any Diversion Assistance is not counted as income.

·      If earned income makes family ineligible for Section 1931 Medicaid, exclude all earned income for one year.

Eligibility for Transitional Medicaid

If your family becomes ineligible for Section 1931 Medicaid because of employment, then all of your income is disregarded for 6 months, during which time you are eligible for Transitional Medicaid if you remain otherwise eligible. (Note that Transitional Medicaid starts after the year during which earned income is disregarded.) Eligibility for a second 6-month period is also possible. (See Transitional Medicaid for details.)

Eligibility for Prospective Medicaid

Medicaid eligibility is extended for four consecutive months to families who become ineligible for Medicaid under Section 1931 because of a new or increased collection of child or spousal support.
