Head of Household - Section 8

If you are living alone then you are considered the family head. If your family has more than one member, then you must designate a member as the Head of Household.

HUD regulations give no criteria for determining the head of household. For all questions in WorkWORLD, you should answer in accordance with whatever you have told your Public Housing Agency (PHA).

Just who is considered by your PHA to be the family head of household matters in the following ways:

·      Student Earnings Income Exclusion: Earnings over $480 of full time students are excluded when determining your family's gross non-excluded income (and thus your Section 8 financial eligibility and rent and utilities payment amounts) except if the student is the head of household or the spouse of the head of household.

This means that if a student with earnings of more than $480 per year is designated as the head of household, your family will probably have to pay more rent than if another family member (not married to the student) is considered the head.

·      Income Deductions: When determining your Adjusted Monthly Income (and thus your rent and utilities payment amounts) your PHA deducts $400, and unreimbursed medical, attendant care, and auxiliary apparatus expenses above 3% of your gross non-excluded income if your family is considered elderly or disabled.

This means that if the family member who is designated the head of household (or the spouse of that family member) does not have a disability and is not at least 62 year old, then your family will probably have to pay more rent than if the family member or spouse has a disability or is at least 62.
