Individuals receiving SSDI or SSI are presumed to be eligible. Their application for VR services indicates an intent to achieve an employment outcome. No additional tests of intent are to be imposed.
· An individual must have a physical or mental impairment which for that individual constitutes or results in a substantial impediment to employment
· Physical or mental impairment means a physical or mental condition which materially limits, contributes to limiting, or if not corrected, will probably result in limiting an individual’s employment activities or vocational functioning. Transient medical conditions will not meet the requirements of this section.
· Substantial Impediment to Employment means that a physical or mental impairment (in light of attendant medical, psychological, vocational, educational, and other related factors) impedes an individual’s occupational performance by preventing the obtaining, retaining, or preparing for employment consistent with the individual’s capacities and abilities.
A substantial impediment to employment may also exist when an individual with a disability is employed but cannot obtain a gainful occupation consistent with capacities and abilities. Individuals with a disability who are working substantially below their potential should be provided vocational rehabilitation services to help them engage in occupations more consistent with their capacities and abilities. Their potential, interests, and desires should be determined and the programs developed which will help them reach suitable employment goals. VR services may be aimed at the problems of under-employment, and the marginal and insecure employment of persons with disabilities, but not solely to make it possible for the individual to gain a promotion.
· The individual can benefit in terms of an employment outcome;
· Employment Outcome - Refers to a determination that with the provision of vocational rehabilitation services the individual is likely to enter or retain, as a primary objective, full-time employment, or if appropriate, part-time employment consistent with the capacities or abilities of the individual in the competitive labor market; the practice of a profession; self-employment; homemaking; farm or family work (including work for which payment is in kind rather than in cash); sheltered employment; home-based employment, supported employment, or other gainful work.
· And finally, the individual requires vocational rehabilitation services to prepare for, enter, engage in, or retain gainful employment.
· An applicant with a diagnosed disabling condition which causes for that individual substantial impediments to employment is presumed to be able to benefit from VR services in terms of an employment outcome.
