Continued Payment Under a VR Program (Section 301 Benefits)

Section 301 Benefits provide for continuation of SSDI and/or SSI payments after your physical or mental impairment ceases to be disabling if:

·           You are participating in a vocational rehabilitation program approved under the Rehabilitation Act of 1973, and

·           You are not expected to medically recover at the beginning of the rehabilitation program, but do recover and are no longer considered disabled, and

·           Social Security determines that completion of your training program or participation for a specified period of time will significantly increase the likelihood that you may be permanently removed from the disability rolls.

NOTE: Section 301 applies only to persons in State Vocational Rehabilitation programs; programs under private agencies or self-initiated programs do not qualify.

Payments to you and any related benefits, including Medicare, State services, Medicaid, and/or State Supplementation, if you receive them, will continue until your training is completed, participation in the VR program ceases, or Social Security determines that continued participation will not increase the likelihood that you will be permanently removed from the disability rolls.

Benefits will be terminated the month after the month you stop participating or it is determined that continued participation will not increase the likelihood of your permanent removal from the disability rolls. Once the VR program participation stops for more than 30 days, benefits will be ceased and cannot be resumed.

The continuation of benefits under Section 301 relates solely to the waiver of the disability provisions for SSDI and/or SSI. All other provisions, such as SSI income and resource provisions or limitations on eligibility for dependents or survivors, continue to apply.

NOTE ALSO: Persons who receive continued benefits under Section 301 are not entitled to Trial Work Period (TWP) or Extended Period of Eligibility (EPE).
