The Workers' Compensation Section (WCS) of the Division of Industrial Relations administers Workers' Compensation in Nevada. The following brief summary is intended to provide a general overview of Workers' Compensation coverage and benefits in Nevada. See the separate topic for help with acronyms. For further information contact your local or state Workers' Compensation Program office. This information is based on data originally provided by the U.S. Department of Labor and updated by WCS, and is current as of January 2011.
In Nevada, compensation benefits are adjusted annually, and changes become effective July 1 of each year. The rates shown below are in effect from July 1, 2010 to June 30, 2011.
In Nevada, workers' compensation is compulsory, and no waivers are permitted. There is no state fund. Employers may insure through self-insurance, but not through private carriers or through groups of employers. There is no exemption for employers with small numbers of employees.
Employers may secure coverage voluntarily, even though no statutory provisions are prescribed.
Employers are permitted to provide voluntary coverage.
Full medical benefits are provided with no time or monetary limitations.
The percentage of worker's wage paid is 66 2/3. For weekly payments, there is no minimum and the maximum is $794.31, based on 100% of the Maximum Average Monthly Wage (150% SAWW multiplied by 4.33 weeks). The maximum period of payments is the duration of disability.

For non-scheduled injuries, the maximum period of payments is the duration of disability and there is no maximum payment amount. Ratings for compensation purposes are determined as a percentage of permanent total disability. The percentage of disability is determined by a commission using AMA guidelines. Each 1% of impairment of the whole man is compensated by a monthly payment of 0.6% of the claimant's average monthly wage for 5 years or until the 70th birthday of the claimant, whichever is later.
Nevada has no specific provision for payment of disfigurement benefits.
