If as a recipient of Supplemental Security Income (SSI) you meet the resource limits for SSI, but you have any of the types of resources listed below, then you may not be eligible for Medicaid in Virginia. The Virginia Department of Social Services (DSS) reviews your resource types and amounts and makes the eligibility determination.
NOTE: For purposes of determining eligibility under 1619(b), you are automatically eligible for Medicaid if you had Medicaid coverage in the month prior to receiving earnings sufficient to cause your SSI cash benefits to go to zero and you need Medicaid in order to work. It may be useful to notify the Social Security Administration of your increased earnings (see the SSA Sample 1619(b) Referral Letter topic for more information.) If you become eligible for continued Medicaid coverage in this manner, you should be sure that the Department of Social Services is aware of your 1619(b) status and has you enrolled in Medicaid as a 1619(b) recipient in order to ensure your protected status. · Equity in property contiguous to the SSI recipient's home that exceeds $5,000; or
· An interest in undivided heir property and the equity value of the SSI recipient's share, when added to all other countable resources, exceeds the appropriate Medicaid resource limit; or
· Ownership (equity value) of an SSI recipient's former residence and the recipient is in an institution for longer than 6 months; or
· Equity value in property owned jointly with another person to whom the SSI recipient is not married; or
· Other real property.
