Home and Community Based Services Waiver - Massachusetts

The Home and Community Based Services Waiver allows a MassHealth applicant or member who is certified by the Division of Medical Assistance (DMA) to be in need of nursing facility services to receive certain waiver services at home provided he or she:

(a) is 60 years of age or older, and, if under age 65, is permanently and totally disabled in accordance with the MassHealth definition for adults with disabilities; and

(b) would be institutionalized in a nursing facility unless he or she receives one or more of the services administered by the Executive Office of Elder Affairs under the Home and Community Based Services Waiver authorized under Section 1915(c) of the Social Security act.

The financial eligibility rules for MassHealth HCBW programs are different from those described in MassHealth Standard - Financial Eligibility:

(a) There are asset limits of $2,000 for an individual and $3,000 for a couple; and

(b) The countable income is figured using rules similar to those used in calculating SSI countable income. That is, there is a $20 unearned income deduction and an earned income disregard of $65 plus ½ of the remaining earned income. There are additional deductions for individuals living in long term care facilities.

NOTE: Detailed regulations for the financial eligibility of HCBS Waiver participants can be found in 130 CMR 120. They are available in PDF format at: http://www.mass.gov/Eeohhs2/docs/masshealth/regs_member/regs_memb_520.pdf
