Age - SSI

If you are less than 18 years old and living with one or both of your parents, then SSA may count some of your parents' income as available for your use to reduce your SSI check. This is called Parental Deeming.

Upon reaching age 18, all factors of your SSI eligibility will be reviewed including a disability redetermination (sometimes referred to as a Continuing Disability Review).

If you are 18 years old or older, then SSA considers you an individual and will not deem parental income. If you are still living with your parents, however, SSA may still reduce your SSI check if it is determined that you are receiving In-Kind Support.

If you are less than 22 years old and you are regularly attending school, then you may take advantage of the Student Earned Income Exclusion so that some or all of your earnings are not counted when SSA decides how much to reduce your benefits because of earnings.

NOTE: Before April 2005, students who were married or heads of household were not eligible for the Student Earned Income Exclusion (SEIE) even if they met the other criteria to be considered a student. Eligibility was expanded under H.R. 743, the Social Security Protection Act of 2004 (Public Law 108-203). Effective April 1, 2005 you can qualify for the SEIE if you are under age 22 and you are a student regularly attending school.
