The Oklahoma Workers' Compensation Court applies the law as set out in the Oklahoma Workers' Compensation Act. The following brief summary is intended to provide a general overview of Workers' Compensation coverage and benefits in Oklahoma. See the separate topic for help with acronyms. For further information contact your local or state Workers' Compensation Program office. This information is based on data originally provided by the U.S. Department of Labor and updated by the Oklahoma Workers' Compensation Court, and is believed current as of January 2011.
Benefit rates do not change annually.
The rates shown below are in effect from November 1, 2008 to October 31, 2011.
In Oklahoma, workers' compensation is compulsory, and no waivers are permitted. There is a competitive state fund. Employers may insure through private carriers, self-insurance, or through groups of employers. There is no exemption for employers with small numbers of employees.
Covers all workers employed in agriculture or horticulture by an employer who had a gross annual payroll, including money paid to independent contractors, in the preceding year of $100,000 or more.
Covers any person employed as a domestic worker if the employer had a gross annual payroll in the preceding calendar year of $10,000 or more for such workers.
Full medical benefits are provided with no time or monetary limitations.
The percentage of worker's wage paid is 70. For weekly payments, the minimum is $30 or actual wage, if less and the maximum is $683, 100% of SAWW. The maximum period of payments is 156 weeks, but the period of disability can be extended to 300 weeks by the WC court for good cause.

The percentage of worker's wage paid is 50. For weekly payments, the minimum is $30 or actual wage if less, and the maximum is $342, 50% of SAWW. For non-scheduled injuries, the maximum period of payments is 500 weeks and the maximum payment amount is $171,000.
Oklahoma law covers disfigurement that is "Serious and permanent". Benefits are a maximum of $20,000.

NOTE: SB1X, the Comprehensive Workers' Compensation Reform Bill, was signed by the Governor on June 6, 2005. Most sections of the act (including those governing prescription drugs and diagnostic tests) became effective 7/1/05, but two sections pertaining to tax benefits became effective 7/1/06. In addition to the effective dates, various provisions of the bill have different operative dates [e.g. Multiple Injury Trust Fund (MITF) reinstated and liability for combined disabilities constituting permanent total disability shifted from the last employer to the MITF for actions in which the subsequent injury occurred after 10/31/05; certain lump sum death benefits apply to deaths occurring after 10/31/05; new workers' compensation fee schedule must be implemented by 1/1/06)].
