Under Public Law 106-419, VA identified the birth defects of children of women Vietnam veterans that 1) are associated with Vietnam service; and 2) result in permanent physical or mental disability. Children must have been conceived after the date on which the veteran first entered the Republic of Vietnam during the period beginning on February 28, 1961, and ending on May 7, 1975. (Spina Bifida however, is covered under the VA's Spina Bifida Program.) The VA Health Administration Center (HAC) in Denver, Colorado HAC is responsible for all aspects of the Children of Women Vietnam Veterans Program, including the authorization of health care benefits and the subsequent processing and payment of claims.
VA identifies the birth defects as those that are associated with the service of the mother in Vietnam and resulted in permanent physical or mental disability. Birth defects not included in this benefit program are those abnormalities that result from the following: 1) a familial disorder; 2) a birth-related injury, 3) a fetal or neonatal infirmity with well-established causes. The law defines the term "child" as an individual, regardless of age or marital status that is the natural child of a woman Vietnam veteran, and was conceived after the veteran first entered Vietnam.
The legislation and implementing regulations provide for health care services, vocational training, and a monthly allowance for eligible children. Level of disability will determine the amount of the monthly monetary amount, with the highest levels of permanent impairment receiving payment at Level IV.
These monthly rates normally change annually on December 1. The rates shown below are effective December 1, 2011 and are current as of January 2012.
