Real Property Overview - SNAP (Food Stamps)

In the Supplemental Nutrition Assistance Program (SNAP, formerly Food Stamp Program), real property includes land, all buildings, structures, improvements, or other fixtures on it belonging or pertaining to the land and all mines, minerals, fossils, and trees on or under it. In addition to a household's primary home, real property may consist of a life estate or other buildings.

A mobile home is real property if it is attached to a foundation on land owned by the household. However, a mobile home does not have to be attached to a foundation in order to be considered real property for residents of Alabama or New Hampshire. A mobile home is defined as real property if it is assessed as such for residents of Arkansas.

Exclude real property that serves as the household's primary home. Also, exclude real property if it is earning a reasonable rate of return. In addition, exclude real property that the household is making a good faith effort to sell at a reasonable price or if the real property is held in probate. For residents of Colorado, real property that has an equity value of less than one-half of the applicable resource standard is not counted.

If real property is counted, then it is valued at its equity value (fair market value less encumbrances).

As with all assets, real property that is owned jointly by separate households is considered available in its entirety to each household unless the household demonstrates that the real property is inaccessible. If the household can demonstrate that it has access to only a portion of the real property, the value of that portion of the real property is counted toward the household's resource level. The real property is considered totally inaccessible to the household if the real property cannot practically be subdivided and the household's access to the value of the real property is dependent on the agreement of a joint owner who refuses to comply.
