Public Disability Benefits - Exclusions

Some disability-related payments are excluded from being considered as a Public Disability Benefit (PDB). None of these exclusions necessarily apply to workers' compensation (WC) payments. Specifically excluded benefits are:

· All Veterans' Administration (VA) benefits paid under Title 38, U.S.C., including Agent Orange payments.

· Needs-based benefits (e.g. Supplemental Security Income (SSI) payments).

· Federal, State, and local disability benefits based on State or local employment if all or substantially all of the employment on which the benefit is based was covered for Social Security purposes.

· Private pensions or insurance benefits.

· For disability benefits with onset of disability 5/1/81, or later, Federal benefits based all or substantially all (85% or more) on any employment covered for Social Security purposes.

· For disability with onsets 3/1/81 through 4/30/86, where the entitlement is September 1981 or later, Federal benefits based in whole or part on employment covered for Social Security purposes.
