Sometimes there is confusion about what benefits are from a private plan, public disability benefit plan (PDB) or workers' compensation (WC) plan.
You can receive a PDB or WC benefit which is administered by a private insurance company. That benefit may therefore appear to be from a private plan. But, if that benefit is paid based upon a State or Federal WC plan, or a Federal, State, or local PDB plan it is NOT a private plan.
If a private company is involved in your disability-related payment/s, it is critical to determine if the company is administering a private plan or administering a WC or PDB plan. When the company administers a private plan the benefits are not offset. When the company administers a WC or PDB plan, benefits are subject to offset and your benefits may be reduced.
