Montana WC - Return to Work

When a Workers' Compensation claimant returns to work his entitlement to Temporary Total Disability benefits ceases. If his return to work occurs prior to maximum healing, and he is earning less than at the time of injury (as a result of the injury), the worker may be entitled to Temporary Partial Disability Benefits. This benefit rate is the difference between the worker's earnings at the time of injury and his post injury earnings, not to exceed his total disability rate. This benefit can be paid up to 26 weeks.
