To determine eligibility for Families Achieving Independence in Montana (FAIM), the family must meet specific financial (income and resources) and non-financial requirements. The family members' prospective income, earned and unearned, is evaluated. There are certain types of excluded earned income, and an extensive list of excluded unearned income, both with additional conditions. If not excluded, the income is tested against the Gross Monthly Income Standard (GMI), the Net Monthly Income Standard (NMI), and the Benefit Standard for the household size and circumstances. If the family fails any of these tests, it is not eligible for benefits.
The State Legislature sets the benefit standard at a percentage of the federal poverty index. The net income standard is determined by dividing the benefit standard by 78.5%. The gross income standard is 185% of the net income standard.
The family's countable prospective income is first tested against the GMI. To pass this test, the family's countable income must be equal to or less than the standard for the family size. Income disregards are then subtracted in a specific order from the monthly gross income to establish the family's net monthly income. Once the net monthly income amount is determined it is tested against the net monthly income standard. To pass this test, the family's net countable income is tested against the benefit standard. If income passes the Net Monthly Income test, the net countable income is subtracted from the benefit standard to determine the cash payment.
The family's resources are evaluated and the equity value of the countable resources is tested against the resource limitation of $3,000.
Families losing FAIM eligibility due to increased income, from any source, are eligible to receive transitional (extended) Medicaid and/or transitional (extended) child care for a period of twelve months following the month of closure.
