NOTE OF CAUTION: California is a State in which Reverse Offset does not apply to all possible Workers' Compensation (WC) payments. Regular offset of Social Security Disability Income (SSDI) benefits could be involved. Therefore reduction of SSDI benefits could occur. It is essential to determine details of your case before an offset determination can be made.
If you receive a basic California Workers' Compensation (WC) payment you are subject to Regular Offset. However, Lump Sum (LS) awards may require special development. If a LS award is involved in your case, clarification should be sought from Social Security before attempting to allocate for monthly offset. If contact with SSA is necessary they will need information regarding the amount and type of the LS award.
In some situations your Social Security Disability Insurance (SSDI) benefit will not be reduced because your WC benefit is being Reverse Offset. Situations under which California Reverse Offset applies are:
· Subsequent Injury Fund: California has a dollar-for-dollar reduction provision, which applies only against payments made from the subsequent injury fund.
· Industrial Disability Leave: State employees in California who receive IDL payments.
