Montana Reverse Offset

NOTE OF CAUTION: Montana is a State in which Reverse Offset does not apply to all possible WC payments. Regular Offset of Social Security Disability Insurance (SSDI) benefits could be involved. Therefore reduction of SSDI benefits could occur. It is essential to determine details of your case before an offset determination can be made.

If you receive Workers' Compensation (WC) in Montana, your Social Security Disability (SSDI) may not be reduced. Instead, your WC benefit could be reduced by what is called "Reverse Offset." Reverse Offset only applies in Montana to adjust the amount of your Temporary Total (TT) and Permanent Total (PT) WC when you are also entitled to Social Security Disability Insurance (SSDI) based on the same injury that occurred on or after 7/1/71.

If your WC and SSDI benefits are not based on the same injury OR WC benefits are not either PT or TT, then Regular Offset provisions apply. When Regular Offset provisions apply, your SSDI benefit could be reduced.
