If you are an SSI recipient living with other people, SSA determines whether or not you are receiving In-Kind Support from them. If you are, SSA reduces your SSI cash benefit. SSA uses one of two methods to reduce your check, either the "1/3rd Reduction Rule" or the "Presumed Maximum Value" (PMV) Rule.
If your check is currently being reduced because of In-Kind Support, the only way to find out which rule is being applied is to ask your SSA Claims Representative.
See the "One-Third Reduction Rule" and "PMV In-Kind Support" topics to compare the advantages of each method.
NOTE: If you are under age 18 and living with your parents, or if you are living with a spouse who is not an SSI recipient, then parental deeming or spousal deeming —rather than In-Kind Support—will reduce your benefit, if it is reduced.
ALSO NOTE: If you are in a "Supported Living" situation, the 1/3rd Reduction Rule will not apply to you. SSA will determine the amount of in-kind support under the Presumed Maximum Value (PMV) rule, or an amount less than that, if you contribute to your living expenses.
ADDITIONAL NOTE: As of March 9, 2005, SSA does not count clothing in the definition of in-kind support and maintenance. For more information see:
